These terms govern the use of arkyn.com.ar and your relationship with Arkyn Helados when you order a product, a custom order or a quote. They are written to be understood: if anything is unclear, write to us and we will explain.

arkyn.com.ar is an informational site: it shows the products, the flavours, the shops and the ways to order. There is no online payment and no shopping cart. Orders are placed at the counter, on WhatsApp, or through the delivery apps (Rappi in Argentina, Glovo in Spain). The sales contract comes into being when we confirm the order, not when you browse the site.

3.Prices, photos and availability

• Published prices are for reference and may change without notice. The price that applies is the one confirmed when the order is placed.
• Each shop's prices are in its own currency and are not equivalent to one another.
• Photos and 3D renders are illustrative. The ice cream is artisan and made in small batches: colour and finish vary from one batch to the next.
• The display case changes every day. A flavour listed here may not be available at the time; if it matters, it is worth asking on WhatsApp first.
• Classic ice pops are not sold individually at the counter: they are made by the batch only, for events and businesses (see point 5).

4.Orders and custom orders

Some things are ready; others are made to order. These are the lead times:

A custom order is accepted once we agree on product, quantity and date, and you confirm it through the channel where it was arranged. If a custom order is not collected on the agreed date, we write to you before disposing of it.

5.Deposits and cancellations

Custom orders for events and businesses may require a deposit before they go into production. The deposit is agreed in writing along with the quote and counts towards the final price.

The deposit is 50 % of the total and is charged when the order is confirmed. It is what holds the date and sets production in motion: ingredients are bought, the kitchen's schedule is blocked and other orders for that day are turned down. For that reason, if the order is cancelled, the deposit is not refunded. The remaining 50 % is paid on delivery.

These are made-to-order products that cannot be resold: by their nature they fall outside the right of withdrawal that applies to catalogue products.

6.Allergens and product information

We produce in a kitchen that handles milk, egg, nuts, peanuts, gluten and soya. Even where a recipe contains none of those ingredients, we cannot guarantee the complete absence of traces: our gluten-free and vegan products are identified by their recipe, not by a separate production line. If you have an allergy, tell us before ordering.

7.Club Arkyn

Joining the Club is free and voluntary. Points and benefits:

• They are personal and non-transferable, and have no cash value: they cannot be exchanged for money or passed to another person.
• They are credited on purchases actually paid for and deducted if a purchase is cancelled.
• Points expire 60 days after your last purchase, and every new purchase resets that period for all accumulated points. In other words: as long as you keep coming back, you lose nothing.
• Benefits may be changed or discontinued with notice through the Club's channels.
• Joining the Club and receiving news require your consent, which you can withdraw at any time from the unsubscribe link in any message.

8.Quotes for businesses and events

• A quote is an offer subject to confirmation of availability and date, and its validity is stated in the quote itself.
• The minimum quantities and lead times in point 4 also apply to quotes.
• Custom ice pops with a logo require approval of the artwork beforehand and the client's sign-off on colours and finish before production.
• The client declares that they hold the rights to the trade marks, logos or images they ask us to reproduce, and is responsible for them.

9.Intellectual property

The texts, photos, 3D models, visual identity and code of this site belong to Arkyn Helados and may not be reproduced without written permission.

The 3D DC character ice pops are made and sold under official licence. DC characters, names and logos are trade marks of their respective owners: Arkyn uses them under licence and claims no rights over them. Third-party trade marks appearing on the site (Rappi, Glovo, Instagram, WhatsApp) belong to their owners.

10.Third-party links and services

The site links to platforms we do not operate: delivery apps, social networks and WhatsApp. What happens inside them is governed by their terms and their prices, which may include the channel's own surcharges. We are not responsible for their availability or their content.

11.Use of the site

The site is provided as is. We make reasonable efforts to keep the information correct and up to date, but there may be data-entry errors or interruptions for maintenance. The site may not be used for unlawful purposes, nor may anyone attempt to breach its security or extract its content automatically for reuse.

12.Liability

We are responsible for our products and for the service we provide, on the terms set by law. Nothing in these terms limits the rights granted to you by consumer protection law, which cannot be waived.

13.Personal data

How we handle your data is set out in the Privacy and Cookies Policy, which forms part of these terms.

14.Changes to these terms

We may update them when what we offer or the applicable law changes. The date above marks the latest version, which applies from the moment it is published. Orders and custom orders already confirmed are governed by the terms in force when they were confirmed.

15.Governing law

Argentine law applies to transactions at the Buenos Aires shop, including Consumer Protection Act 24,240, and the ordinary courts of the City of Buenos Aires have jurisdiction.

For transactions at the Málaga shop, Spanish and European Union consumer law applies. If you are a consumer habitually resident in the EU, you keep the protection of the mandatory rules of your country of residence.
